Colorado Dealing with Tenants Growing Medicinal Marijuana

The State of Colorado currently allows for the possession of a limited quantity of useable marijuana and marijuana plants for medicinal purposes. Many commercial property managers currently lease space to medicinal marijuana dispensaries, and now some residential property managers have encountered individual tenants growing marijuana in their rental properties. Property managers have concerns about the negative affects a property may experience due to the growth and smoking of marijuana. It was originally believed that a crime free lease addendum would prevail over state law, but there now appears to be some disagreement on the legality of that argument. Visit the Colorado Department of Public Health and Environment for more information on this issue.

Southwest Regional Vice President Carolyn Rogers, MPM® RMP®, has organized a meeting with various stakeholders on May 27th, 2010 at 9 am to discuss these concerns. Please e-mail her at southwestrvp@narpm.org for more information regarding this meeting.

Colorado Considers Rent Control Legislation

The Colorado General Assembly is currently considering legislation that would modify a decades-old prohibition on rent control so that municipalities and counties are able to negotiate and enter into agreements with developers, requiring them to develop based on the wishes of local government.

House Bill 1017, sponsored by Rep. Daniel Kagan (D-Englewood) passed the House on March 1st and is now being considered in the Senate. Click here to access a recent article regarding this legislation. For more information, please contact Carolyn Rogers at southwestrvp@narpm.org.
