President Trump signed an extension of the Paycheck Protection Program (PPP) to August 8. The program had an original end date of June 30. There is still approximately $132 billion left in the program.

“With the new $10 billion in funding for Emergency EIDL Grants that the interim COVID-19 act provides, the Administration should remove the limitations it imposed that prevent businesses from receiving a full $10,000 grant. Businesses that have previously received reduced grants because they have fewer than ten employees should receive the full amount, and, going forward, new recipients should receive full awards as well, regardless of their size. Furthermore, to prevent the Administration from once again refusing to request additional appropriations when the program is fully subscribed, SBA should notify Congress as soon as funds begin to run low rather than cut the amount small businesses receive. In addition, it should dedicate the resources it has received for administrative expenses to ensure that loans go out within the statutorily mandated three-day time frame.”

“In the next bill, it is critical for Congress to provide additional assistance to struggling homeowners, renters, landlords and people experiencing homelessness. As part of that effort, the Financial Services Committee is proposing the creation of a $100 billion rental assistance fund and $75 billion homeowner assistance fund so that struggling families are able to cover their rent or mortgage payments as well as utility payments. I will be working with my colleagues to ensure that these and other critical elements of the Committee’s proposals to protect and help our communities are included in the next coronavirus response package.”

This list is advisory in nature. It is not, nor should it be considered, a federal directive or standard. Additionally, this advisory list is not intended to be the exclusive list of critical infrastructure sectors, workers, and functions that should continue during the COVID-19 response across all jurisdictions. Individual jurisdictions should add or subtract essential workforce categories based on their own requirements and discretion.

Workers responsible for the leasing of residential properties to provide individuals and families with ready access to available housing.
Workers responsible for handling property management, maintenance, and related service calls who can coordinate the response to emergency “at-home” situations requiring immediate attention, as well as facilitate the reception of deliveries, mail, and other necessary services.
Workers performing housing construction related activities to ensure additional units can be made available to combat the nation’s existing housing supply shortage.
Workers supporting the construction of housing, including those supporting government functions related to the building and development process, such as inspections, permitting and plan review services that can be modified to protect the public health, but fundamentally should continue and serve the construction of housing (e.g., allow qualified private third-party inspections in case of government shutdown).

Florida Attorney, Harry Heist, shares the following: “As suspected, my clients are already trying to dig up previously ignored “reasons” to try to get around the nonpayment of rent eviction ban on “covered” properties. Do me or your attorney a favor. Don’t try it. We can see right through this and a judge can as well. From the Financial Services committee report posted in this group: “Further, landlords would not be allowed to issue a notice to vacate until after this temporary moratorium and they would not be allowed to require a tenant to actually vacate the unit until 30 days after the notice is given. Renters should be advised that the moratorium only applies to evictions for nonpayment of rent, not for other causes. Renters should also be advised that although they may be protected from eviction proceedings temporarily under this bill, the bill does not treat nonpayment of rent during this period as forgiven and these unpaid amounts will accrue during this period even if fees are not assessed.” – post from Gail Phillips, CEO in NARPM Facebook Discussion Group, April 2, 2020
If your state orders to a Stay at Home, according to NARPM Past President Eric Wetherington, “I know in SC our state association is imploring the Governor to keep Real Estate as an essential service. I have also seen some comments from various states, including NARPM members in CA, that property management is essential as it relates to housing and can continue to work even during the CA shutdown. From Scott Brady: Real estate sales has been deemed a “non-essential” service in California….no showings, open houses, and therefore…no business for 30 to 60 days. “Yesterday Governor Newsom and the State Public Health Officer issued Executive Order N-33-20 requiring all Californians to stay home except as needed to maintain continuity of operations in 16 infrastructure sectors. This supersedes all existing local city and county orders that are less restrictive. The real estate industry is not exempt from this prohibition except as needed to maintain “continuity of operation … of … construction, including housing construction.” Therefore, REALTORS® should cease doing all face-to-face marketing or sales activities, including showings, listing appointments, open houses and property inspections. Another Good Tip From Harry Heist: Time to revise your PMA. If your state law does not prohibit, always have a minimum monthly management fee. The moment you take on a property, you are working. You have liability. Most property managers started in sales. This is where this commission only mentality has come from. You are not listing a property and getting some huge check when it sells. You are worth it and you deserve it. I and others have been teaching this since the mid ’90s. It is perfectly fair, normal and common in Florida.
